How to appeal a German official decision (Widerspruch)
Got a German Bescheid you think is wrong — a rejection, a tax assessment, a property-tax value, a fine? You can usually challenge it, but only within a short deadline. Here is how the objection works and a plain letter template you can adapt.
Most decisions can be challenged within one month of notification. Miss it and the decision normally becomes final. Find the exact period and the correct remedy in the Rechtsbehelfsbelehrung — the paragraph at the end of your letter.
Widerspruch vs. Einspruch vs. Klage
- Widerspruch — the standard administrative objection against a Bescheid (e.g. Jobcenter, Familienkasse, pension, housing benefit, municipal property tax).
- Einspruch — the same idea in tax matters handled by the Finanzamt (income-tax assessment, the Grundsteuerwert for property tax). Also one month.
- Klage — a lawsuit at a court. Some decisions (often immigration rejections) skip the objection stage and point straight to a Klage at the Verwaltungsgericht. Your Rechtsbehelfsbelehrung tells you which one applies.
The deadline (Widerspruchsfrist)
The usual period is one month from Bekanntgabe (notification). For posted decisions, German law often assumes delivery three days after the date on the letter. The big exception is a Bußgeldbescheid (fine), where the Einspruch deadline is only two weeks. Never rely on a rule of thumb over the date printed in your own letter.
How to file — step by step
- Act early. Don’t wait for the last day; posting delays count against you.
- Write to the issuing authority (the one named at the top of the Bescheid), quoting the reference number (Aktenzeichen) and the date of the decision.
- State clearly that you object. A single sentence is enough to keep the deadline; you can add reasons now or send them later („Begründung folgt“).
- Send it in a provable way — many authorities accept email, but registered post (Einschreiben) or a fax confirmation gives you proof of timely delivery. Keep a copy.
Appeal letter template (Widerspruch)
A simple objection in German. Replace the placeholders in [brackets]. This keeps your deadline; you can follow up with detailed reasons afterwards.
