How to appeal a German official decision (Widerspruch)

Got a German Bescheid you think is wrong — a rejection, a tax assessment, a property-tax value, a fine? You can usually challenge it, but only within a short deadline. Here is how the objection works and a plain letter template you can adapt.

The deadline is everything

Most decisions can be challenged within one month of notification. Miss it and the decision normally becomes final. Find the exact period and the correct remedy in the Rechtsbehelfsbelehrung — the paragraph at the end of your letter.

Widerspruch vs. Einspruch vs. Klage

The deadline (Widerspruchsfrist)

The usual period is one month from Bekanntgabe (notification). For posted decisions, German law often assumes delivery three days after the date on the letter. The big exception is a Bußgeldbescheid (fine), where the Einspruch deadline is only two weeks. Never rely on a rule of thumb over the date printed in your own letter.

Read the Rechtsbehelfsbelehrung first. It states the correct remedy (Widerspruch, Einspruch or Klage), where to send it, and the exact deadline. That paragraph — not this guide — is binding for your case.

How to file — step by step

A simple objection in German. Replace the placeholders in [brackets]. This keeps your deadline; you can follow up with detailed reasons afterwards.

English meaning: „I hereby lodge, within the deadline, an objection (Widerspruch) against the above decision of [date], reference [number]. A detailed reasoning will follow within two weeks. Please confirm receipt in writing.“ For a tax decision from the Finanzamt, replace the word Widerspruch with Einspruch.

Common cases

This guide is general information and not legal advice. Deadlines and the correct remedy depend on your specific Bescheid. For anything high-stakes — a residence permit, a large tax bill, a court deadline — consult a lawyer or a recognised counselling service before you act.

Frequently asked

How long do I have to appeal?
Usually one month from notification. Fines are the exception at two weeks. The exact deadline is in the Rechtsbehelfsbelehrung of your letter — always follow that.
Do I need reasons to file on time?
No. Stating clearly that you object, with the reference number, is enough to keep the deadline. You can submit the detailed reasoning afterwards.
Can I email my Widerspruch?
Many authorities accept email, but a provable channel (registered post or fax confirmation) is safer if the deadline is close. Keep a copy and proof of sending.

Never miss an appeal deadline

Photograph the Bescheid — Mein Büro reads the German, tells you what it is, and counts down the objection deadline so you can appeal in time.
